Refund and Cancellation Policy
Understanding our policies for service engagements, payments, and cancellations.
1. Introduction
Todaysknuckleball is committed to providing high-quality corporate governance and strategic business leadership consulting services. Due to the nature of intellectual property, time, and resources invested in our advisory and consulting services, our refund and cancellation policy is structured to reflect these factors. This policy outlines the conditions under which refunds or cancellations may be considered for services rendered or initiated by Todaysknuckleball.
This policy applies to all services provided by Todaysknuckleball, including but not limited to, corporate governance consulting, leadership development programs, strategic planning facilitation, risk management audits, and executive coaching. By engaging our services, you agree to this refund and cancellation policy.
2. Service Engagement and Payments
Our consulting services are typically initiated through a formal Statement of Work (SOW) or a Service Agreement, which details the scope of work, deliverables, timelines, and payment terms. Payments may be structured as retainers, milestone payments, or hourly fees, as agreed upon by both parties prior to the commencement of work.
- Upfront Payments/Retainers: For certain services, an upfront payment or retainer may be required to secure our services and commence work.
- Milestone Payments: For larger projects, payments may be tied to the completion of specific project milestones.
- Hourly/Fixed Fees: Services may also be billed on an hourly basis or a pre-determined fixed fee for the entire project.
All payment terms will be clearly outlined in your specific service agreement. Payments are expected to be made in a timely manner as per the agreed schedule.
3. No Refunds for Completed Services
Once a service, deliverable, or stage of work has been completed and accepted by the client as per the terms defined in the Statement of Work or Service Agreement, the fees for that specific service, deliverable, or stage are non-refundable. Our services involve the application of specialized knowledge, experience, and the allocation of expert time and resources, which are expended once the work is performed.
This includes, but is not limited to, fees for:
- Completed assessments, reports, or analyses.
- Delivered training sessions, workshops, or coaching hours.
- Facilitated strategic sessions or board meetings.
- Developed frameworks, policies, or strategic plans.
4. Cancellation of Services
Clients may cancel services not yet rendered, subject to the terms below:
- Notice Period: A written cancellation notice must be provided to Todaysknuckleball (via email to info@todaysknuckleball.com) at least 30 calendar days prior to the scheduled commencement of the service or the next billing cycle/milestone, as defined in the service agreement.
- Retainer/Upfront Payment: If a retainer or upfront payment has been made, and cancellation occurs before the commencement of work and within the agreed-upon notice period, Todaysknuckleball may refund a portion of the payment, less any non-refundable deposits, administrative fees, and costs for resources already acquired or committed for the project. The exact amount will be detailed in the service agreement.
- Work Commenced: If work has already commenced (e.g., initial research, team allocation, or preparatory meetings have taken place), any fees for work performed up to the date of cancellation will be due and payable, and no refund will be issued for such performed work. Any remaining unspent portion of a retainer may be refunded after deducting all incurred costs and fees for services rendered.
- Short Notice Cancellations: Cancellations made with less than the stipulated 30-day notice period, or any other period specified in the service agreement, may result in forfeiture of the upfront payment or retainer, or a cancellation fee up to the value of the next scheduled milestone payment, to compensate for lost revenue and committed resources.
5. Project Delays and Postponements
In the event of client-initiated project delays or postponements:
- If a project is delayed or postponed by the client, Todaysknuckleball reserves the right to adjust timelines and may apply additional fees to cover extended resource allocation, administrative overhead, or inflation adjustments.
- Significant or prolonged delays may be treated as a cancellation, subject to the terms outlined in Section 4.
- Any such changes will be communicated and agreed upon in writing with the client.
6. Termination by Todaysknuckleball
Todaysknuckleball reserves the right to terminate a service agreement if:
- The client fails to make payments as per the agreed schedule.
- There is a material breach of the service agreement by the client.
- The client engages in unethical, illegal, or unprofessional conduct impacting the engagement.
- A conflict of interest arises that cannot be remediated.
In such cases, any fees for work completed up to the date of termination will be due and payable, and no refunds for services already rendered will be provided. Any outstanding balance will be immediately due.
7. Disputes
Any disputes regarding refunds or cancellations will be addressed in accordance with the dispute resolution mechanisms outlined in the specific Service Agreement or our general Terms of Service. We endeavor to resolve all concerns amicably and fairly.
8. Policy Updates
Todaysknuckleball reserves the right to modify or update this Refund and Cancellation Policy at any time. Any changes will be posted on this page, and the "Last Updated" date will be revised accordingly. We encourage clients to review this policy periodically.
